These Terms of Use ("Terms") govern your use of Dailyish (the "App"). By downloading, installing, or using Dailyish, you agree to these Terms. If you don't agree, please don't use the App.
Acceptance
You must accept these Terms before using Dailyish. If we make a material change to these Terms, we'll ask you to accept the updated version again before you can keep using the App.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use Dailyish on devices you own or control, for your own personal, non-commercial habit tracking. All rights not expressly granted are reserved.
Not medical or mental-health advice
Dailyish is a habit-tracking tool, not a medical or mental-health service. It does not provide medical advice, diagnosis, or treatment, and quit-habit tracking in the App is not a substitute for addiction treatment or professional support. If you're struggling with a habit, addiction, or your mental or physical health, please talk to a qualified professional. In a crisis, contact local emergency services or a crisis line right away.
On-device AI features
Some features (like Coach, weekly recaps, quick add, and note patterns) use on-device AI models. These generate content automatically and, like any AI system, can occasionally be inaccurate, incomplete, or out of context. Use your own judgment, and don't rely on AI-generated content as professional advice of any kind.
Your content
You own the habits, notes, mood check-ins, and photos you create in Dailyish. You're responsible for what you enter into the App and for keeping your device and iCloud account secure.
"As is" — no warranty
Dailyish is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the App will be uninterrupted, error-free, or achieve any particular result (like building or quitting a habit). You use the App at your own risk.
Limitation of liability
To the maximum extent permitted by law, in no event will we be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, habits, or goodwill, arising out of or related to your use of (or inability to use) Dailyish, even if we've been advised of the possibility of such damages.
To the maximum extent permitted by law, our total aggregate liability to you for any claim arising out of or relating to these Terms or the App will not exceed the greater of (a) the amount you paid us for the App in the twelve (12) months before the claim arose, or (b) US $50.
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the App or your violation of these Terms.
Changes to these Terms
We may update these Terms from time to time. If a change is material, we'll ask you to re-accept the new Terms in the App before you can continue using it. Non-material changes take effect when posted here with an updated "Effective" date.
Termination
You may stop using Dailyish at any time by deleting the App. We may suspend or terminate your ability to use the App if you violate these Terms. Sections that by their nature should survive termination (like the warranty disclaimer, limitation of liability, and indemnification) will survive.
Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles.
